Probate Process

After a loved one passes away, their last wishes are honored by finding their will and following their instructions. However, many wills (and most estates without a valid will) must go through a court process called probate (also called the "appointment of an estate trustee").

The Process

In probate an individual applies to be an executor of the deceased persons estate. If successful, the individual receives a Certificate of Appointment of Estate Trustee which provides them with the legal authority to act as an executor and perform the asset distribution duties required.

The executor may later need to report their actions to the court, in a process called a “passing of accounts”. The probate process is lengthy and competent legal representation is highly recommended.
